Sandra-Ken Freeman Productions Ltd., a Canadian corporation doing business as Freeman Casting (hereinafter referred to as “Company”, “our”, “us” or “we”), values your privacy. For the purposes of this Privacy Policy, “you” and “your” indicates such individual or individual representing an entity browsing this website (the “Website”), owned and operated by the Company, or using any of the services offered by the Company (the “Services”).

We are committed to protecting any Personal Information that is collected by us in connection with the Services and adhere to all applicable privacy legislation, including British Columbia’s Personal Information Protection Act (“PIPA”) and Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”). “Personal Information” is defined as information about an identifiable individual, though it does not include contact information or work product information. Personal Information may include, but is not limited to, photographs, images, a description of personal and/or physical characteristics, date of birth, body sizes, wardrobe, union status, province of residence, country of citizenship, working visa numbers, notice of assessment, address, personal preferences, resume, education, previous credits, hobbies, skills, certifications, and such other information about an identifiable individual as may be required or submitted by individuals in order to be considered for engagement as a background performer.

By using the Website or the Services, you confirm that you have carefully read and understood this Privacy Policy and that you are consenting to the Company’s collection, use and disclosure, as described herein, of such Personal Information. You also authorize us to retain, store and use this Personal Information for as long as it may be required for the purposes described herein. Consent may also be obtained by the Company in writing or verbally, in person or over the phone. Your consent remains valid even after the termination of our relationship with you, unless you provide us with written notice that such consent is withdrawn. If you do not consent to the collection, use and disclosure of your information, please discontinue use of the Company’s Services and Website. The Company reserves the right to make any amendments to this Privacy Policy at any time and for any reason. Any amendments may also apply to information collected under a previous version of this Privacy Policy and such amended version will be posted on the Website.

 

The Company’s Privacy Principles

The Company is committed to maintaining the accuracy, confidentiality and security of your Personal Information. As part of this commitment, the Company has adopted the following ten principles, based on the principles set out in PIPA and PIPEDA.

  1.  Accountability: The Company is responsible for Personal Information under its control and shall designate one or more individuals to be accountable for its compliance with these principles. In being accountable for this responsibility, the Company has implemented and established procedures to protect Personal Information and train staff accordingly.
  2. Identifying Purposes: The purposes for which Personal Information is collected shall be identified before or at the time the Personal Information is collected by us from you.
  3. Consent: Consent will be obtained for the collection, use or disclosure of Personal Information, except where applicable law provides an exemption.
  4. Limiting Collection: The Personal Information we collect shall be limited only to that Personal Information which is necessary for the purposes identified.
  5. Limiting Use, Disclosure and Retention: Personal Information shall only be used or disclosed for the purposes for which it was collected, unless an individual has otherwise consented or when it is required or permitted by law. Personal Information shall be retained only as long as necessary for the fulfillment of those purposes.
  6. Accuracy: The Company shall keep Personal Information as accurate, complete and up-to-date as may be necessary to fulfill the purposes for which it is to be used.
  7. Safeguards: The Company shall protect Personal Information using security safeguards that are appropriate to the sensitivity level of the Personal Information received.
  8. Openness: The Company will provide information to individuals about our policies and procedures relating to the management of Personal Information that is under our control.
  9. Individual Access: Upon written request to our Privacy Officer, an individual will be informed of the existence, use and disclosure of their Personal Information that is under our control, and may be given access to that information as required and permitted by law. Individuals are entitled to challenge the accuracy and completeness of the information and request that it be amended, if appropriate.
  10. Compliance – Addressing Inquiries or Complaints: Any questions, inquiries, or complaints concerning compliance with this Privacy Policy or any related procedures may be addressed to our Privacy Officer, as set out below.

 

Collection, Maintenance, and Use

The Company provides casting services to production companies, networks, agencies, managers, casting directors, and other motion picture, theatrical, radio, television, and entertainment professionals which includes the aggregation of casting application submissions from people wishing to be considered as potential candidates in the casting search.

The Company collects Personal Information to the extent necessary to deliver the Services or otherwise as is noted herein. This Privacy Policy applies to all information, including Personal Information, collected via the Website or via the application containing Personal Information provided to us by you. The Company collects Personal Information from you when you use the Website and when you submit an application to the Company to be considered for casting. The Company may in the future collect Personal Information online from you when requested by the Company to verify your submitted Personal Information, when you use the Company’s products or Services, when you register to attend a seminar or participate in an online survey, when you ask to be included in an email or other mailing list, when you submit an entry for a promotion, when you submit an application during an open casting call, or when you submit your Personal Information to the Company for any other reason. The Company may also collect Personal Information from third parties. The Company may combine information that we receive from the various sources described in this Privacy Policy, including third-party sources, with information you provide and use or share it for the purposes identified herein.
The Company may collect and use all or any portion of your Personal Information for the purposes of providing features of our Website, providing the Services, selecting you (if at all) as a prospective candidate for casting in one or multiple film, television and/or other productions, verifying the accuracy and truthfulness of the submitted Personal Information, storing and maintaining your information on a database of prospective background performers, determining eligibility for products and services, researching potential enhancements to the Website or Services, researching potential enhancements to our marketing practices, managing your application and our relationship, communicating with you, assessing your future needs, communicating with a third party, or otherwise managing our business. The Company’s use of your Personal Information is not limited to the foregoing, but such use is limited only to the extent necessary to deliver the Services or operate the business. Personal Information may also be used for other purposes, subject to obtaining your prior consent for such use. If the Company does not select you as a prospective candidate for casting in current or future film, television and/or other productions, the Company will discard and delete your Personal Information.

The Company may disclose any of the Personal Information we collect to affiliates, subsidiaries, successors and other service providers or agents who perform various functions for us. The Company may further disclose any of the Personal Information to other casting personnel, producers, companies or other persons under any of the following circumstances: (i) when the Company has your consent to share the Personal Information; (ii) the Company needs to share your Personal Information to recommend your engagement as a background performer on a film and/or television production; (iii) the Company needs to send the Personal Information to companies who work on behalf of the Company to provide a product or service to you (the Company will only provide those companies the information they need to deliver the service); or (iv) the Company wants to keep you up to date on the latest product or service announcements, special offers or other information the Company thinks you would like to hear about. In certain circumstances, we may be required to provide Personal Information to third parties for legal or regulatory purposes, to enforce the Company’s Terms of Use, or in urgent circumstances to protect personal safety, the public or the Website.

PIPA further deems that an individual has consented to the Company’s collection, use or disclosure of Personal Information about the individual if, at the time the consent is deemed to be given, the purpose would be considered obvious to a reasonable person. In such circumstances, the Company will collect, use or disclose Personal Information without obtaining written or verbal consent to do so.

It is important that your Personal Information is current, accurate, factual and complete. The Company relies on you to keep us informed of any changes, simply by contacting us. If you identify any Personal Information that is out-of-date, incorrect or incomplete, please let us know. We will make the corrections promptly and use every commercially reasonable effort to communicate these changes to other parties who may have inadvertently received incorrect or out-of-date Personal Information from us.

 

Children’s Privacy

We do not purposefully or knowingly collect Personal Information from individuals under the age of majority in the jurisdiction of their residence (“Minor”) without the consent of their parent of legal guardian. If you are a parent or guardian and you are aware that your Minor has provided us with Personal Information without your consent, please contact us. If we become aware that we have collected Personal Information from Minors without verification of parental consent, we will discard and delete said Personal Information.

 

Safeguarding Personal Information

At the Company, we employ physical, electronic and procedural safeguards to protect our systems and all Personal Information under our control against unauthorized access and use. All safety and security measures are appropriate to the sensitivity level of the information collected. Our service providers and agents are required to maintain client confidentiality, and may not use any information provided by us for any unauthorized purpose. Employees of the Company are governed by strict standards and policies to ensure that Personal Information is secure and handled with due care.

Our Website may contain links to third-party sites not controlled by the Company or covered by this Privacy Policy, such as those belonging to governments, unions, payroll companies or search engine companies. We do not share your Personal Information with those websites and we are not responsible for their privacy practices. The Company cannot guarantee, and hereby disclaims any responsibility, that any third party, whether referred by us or through a direct link, adheres to this Privacy Policy or to the third party’s own privacy policy. We also cannot guarantee nor represent and warrant that a third party adheres to our Terms and Conditions Agreement or to the third party’s own terms of use. For example, we cannot guarantee that a producer with which we connect you respects your privacy or takes reasonable steps to secure your Personal Information. If you have any questions, comments, or concerns related to a third party, please direct your questions, comments, or concerns to that third party.

The Company’s Website may use “cookies” and other tracking technologies to gather information about your visit (such as demographic data, browser type, IP address, pages visited, length of visit, activities conducted on the page, and the day and time of your visit). Cookies remember user preferences and maximize the performance of our Website and Services.
